1. Introduction & marketplace definition
Southeastern Glow ("Southeastern Glow," "we," "us," or "our") operates a technology platform that helps independent beauty service providers ("Artists") connect with consumers seeking beauty services ("Clients"). Our services are offered through our website, mobile experiences, and related tools (collectively, the "Platform").
Southeastern Glow is a marketplace, not a beauty services provider. We do not perform spray tans, hair styling, makeup application, nail services, or any other cosmetic or beauty treatment. We do not employ, supervise, or control Artists, and we are not a party to the service contract formed between a Client and an Artist when a booking is made.
- Artists are independent contractors responsible for their own licenses, qualifications, equipment, scheduling, pricing, and conduct.
- Clients choose Artists at their own discretion and are responsible for evaluating an Artist's skills, reviews, and suitability.
- Southeastern Glow does not guarantee the quality, safety, legality, or outcome of any service performed by an Artist.

2. User accounts & eligibility
To book services, list services, or access certain Platform features, you must create an account and provide accurate, current information. You must be at least 18 years old and capable of entering a binding contract.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide truthful profile information and to keep your contact details up to date. Email is required for account and booking updates. A mobile number and SMS opt-in are optional and are never required to create an account or complete a booking.
- Users selecting a "Verified Student" profile status warrant that they are currently enrolled at an accredited higher education institution. Southeastern Glow reserves the right to request proof of student status or remove badges at its discretion.
- You may not create an account on behalf of another person without authorization, impersonate others, or use the Platform for unlawful purposes.
- We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, attempt to circumvent fees, or pose a risk to users or the Platform.
- Termination may occur with or without notice where permitted by law. Outstanding payment obligations survive termination.
3. Limitation of liability & service disclaimers
Beauty and cosmetic services carry inherent risks. Clients should disclose allergies, medical conditions, skin sensitivities, and medications to their Artist before any treatment. Artists are solely responsible for obtaining informed consent and following applicable professional standards.
- Southeastern Glow does not warrant that any service will achieve a particular result, last for a specific duration, or be free from adverse effects.
- We expressly disclaim liability for allergic reactions, skin irritation, burns, infections, staining, hair or nail damage, dissatisfaction with appearance, or any other injury or loss arising from services performed by an Artist.
- The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- To the fullest extent permitted by law, Southeastern Glow will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption.
- Our total cumulative liability to you for any claim arising out of or relating to the Platform or these Terms is limited to the greater of (a) the total platform fees you paid to Southeastern Glow in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
- Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by applicable law.
4. Fees & payments
Southeastern Glow may charge platform, processing, or service fees in connection with bookings and marketplace activity. Applicable fees are disclosed before you confirm a transaction or listing, as displayed on the Platform.
- Payments are processed through third-party payment providers, including Stripe. By making or receiving payments through the Platform, you also agree to the applicable payment processor terms.
- Clients authorize Southeastern Glow and its payment processors (Stripe) to securely store payment card details upon booking. Clients acknowledge that cards may be charged upon service completion or in the event of an applicable late-cancellation or no-show fee as defined by the Artist's policy.
- We are not a bank, money transmitter, or escrow agent. Funds flow according to the payment flows presented at checkout or in your Artist dashboard.
- Southeastern Glow offers both transaction-based commission options and recurring subscription tiers (e.g., for commercial business clients). Subscription fees auto-renew monthly and are non-refundable once billed.
- Platform usage fees, booking fees, and similar charges paid to Southeastern Glow are generally non-refundable except where required by law or expressly stated in a cancellation policy shown at booking.
- Service charges between Clients and Artists are governed by the Artist's stated policies and the booking confirmation. Disputes over service quality must be resolved directly between the Client and Artist unless we choose to assist at our discretion.
- You authorize us and our payment partners to charge your selected payment method for fees, taxes, and amounts you approve at checkout.
- Failure to pay amounts when due may result in suspension of booking privileges or account termination.
5. Indemnification
You agree to defend, indemnify, and hold harmless Southeastern Glow and its officers, directors, employees, contractors, and agents from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Platform or violation of these Terms.
- Your interactions with other users, including bookings, cancellations, no-shows, or disputes.
- Services you provide as an Artist, including alleged negligence, misrepresentation, or failure to meet professional standards.
- Content you submit, including photos, reviews, portfolio images, or profile information that infringes third-party rights.
- Your violation of applicable law, including health, safety, licensing, or tax obligations.
We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.
6. SMS program
SMS opt-in is optional. Email is the default way we send account and booking updates. On our website signup form, booking checkout, and SMS opt-in page, you may check a box that starts unchecked. Checking that box is the only way you consent to texts. Providing a phone number or creating an account does not opt you in. You can skip SMS, continue with email, and still use Southeastern Glow.
If you check the box, you agree to receive text messages from Southeastern Glow for account verification, booking updates, appointment reminders, cancellations or declines, and receipts. Message frequency varies with your account and booking activity. Message and data rates may apply.
- Consent is not a condition of purchasing any goods or services. You may skip SMS and still create an account or book using your email.
- Reply STOP to opt out of further messages. Reply HELP for help, or email help@southeasternglow.com.
- We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.
- Carriers are not liable for delayed or undelivered messages.

7. General provisions
- Bookings: When a Client requests or confirms a booking, a direct service relationship is formed between the Client and Artist. Southeastern Glow facilitates discovery, scheduling, and payment tools but is not responsible for fulfillment.
- Prohibited conduct: Users may not harass others, post false reviews, scrape the Platform, interfere with security, or use the Platform to promote illegal activity.
- Changes: We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
- Governing law: These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles, except where mandatory consumer protections apply.
