1. Independent contractor relationship
You are an independent contractor, not an employee, partner, joint venturer, or agent of Southeastern Glow. Nothing in this Agreement creates an employment relationship. By accepting this Agreement you represent that you are at least eighteen (18) years of age and legally able to enter this contract and provide the services you list.
- You warrant that you are 18 or older. If that representation is false, Southeastern Glow may suspend or terminate your account without liability.
- You control how, when, and where you perform beauty services, subject to law and Platform rules.
- You may provide services to others and use other platforms.
- Southeastern Glow does not provide wages, overtime, paid leave, unemployment, workers’ compensation, or employee benefits.
- You are solely responsible for all taxes on amounts you earn, including self-employment taxes, and for any required business registrations.
- You will not hold yourself out as an employee or authorized representative of Southeastern Glow.
2. Marketplace role
Southeastern Glow operates a technology marketplace that helps Clients discover and book Artists. We do not perform beauty services and are not a party to the service contract between you and a Client, except for Platform fees, payment processing facilitation, and booking-tools described in the Terms.
- Clients select you at their discretion based on your profile, services, and reviews.
- You set your own service menu, pricing (where the Platform allows), availability, and studio policies, consistent with law and the Terms.
- Independent and campus Artists: clients who book through the Platform provide a card and pay through Stripe after the service. Commercial studios on seat subscriptions: clients book through the Platform and pay at the business; seat fees still apply as disclosed.
3. Licenses & professional compliance
You represent and warrant that you (and any staff you bring onto the Platform through a business roster) hold all licenses, permits, and certifications required by applicable law to offer the services you list — including Mississippi cosmetology or manicurist licenses where required for hair or nail services.
- You will keep licenses current and remove or pause listings if you are not authorized to perform a service.
- You authorize Southeastern Glow to request proof of licensing and to suspend listings that appear non-compliant.
- You are responsible for complying with health, sanitation, advertising, and mobile-service rules in each location you serve.
4. Insurance
You are solely responsible for obtaining and maintaining liability (and any other) insurance appropriate for your services and business. Southeastern Glow does not insure your work, tools, premises, or Clients.
- You will maintain coverage at least as required by law or by any venue that hosts your work.
- Upon reasonable request, you will provide certificates of insurance.
- Failure to maintain appropriate insurance is grounds for suspension or removal from the Platform.
5. Service standards & Client safety
- You will perform services in a professional, lawful, and non-discriminatory manner.
- You will obtain informed consent from Clients, screen for contraindications, and follow product manufacturer guidance.
- You will not book or perform services you are not qualified or licensed to provide.
- You are solely liable for injuries, allergic reactions, property damage, or dissatisfaction arising from your services.
6. Fees, payouts & subscriptions
- Campus / solo Artists may pay Platform commission on completed card-captured bookings as disclosed in the Terms and at checkout.
- Commercial businesses may pay recurring Standard seat fees and optional Premium listing fees; those subscriptions renew until canceled as disclosed at checkout and in the Terms.
- You authorize Stripe (and Connect, where used) to process payouts and identity verification according to Stripe’s terms.
- Returns, redos, and service refunds are your responsibility as the service provider. Southeastern Glow is not responsible for Client returns or dissatisfaction with your work.
- Chargebacks, refunds, and payment disputes are handled as described in the Terms. You agree to cooperate and may be responsible for amounts reversed on your bookings.
7. Profile content & intellectual property
You grant Southeastern Glow a non-exclusive, worldwide, royalty-free license to host, display, and promote your profile, portfolio, and service descriptions on the Platform and in marketing that features marketplace Artists. You represent that you own or have rights to all content you upload, including model releases where needed.
8. Indemnification
You will defend, indemnify, and hold harmless Southeastern Glow and its officers, directors, employees, and agents from claims arising out of your services, premises, staff, licensing, insurance gaps, Client interactions, content you upload, or your breach of this Agreement or the Terms.
9. Term & termination
- Either party may end this contractor relationship by closing or suspending the Artist account as allowed in the Terms.
- Southeastern Glow may suspend or terminate access for policy violations, legal risk, non-payment, or inactivity.
- Sections on taxes, insurance, IP license (for content already published), indemnity, and surviving payment obligations continue after termination.
10. General
- This Agreement is governed by the same governing-law provisions as the Terms of Service.
- If any provision is unenforceable, the rest remains in effect.
- Electronic acceptance (checkbox + account creation or onboarding completion) is intended to have the same effect as a signed writing.
- Southeastern Glow may update this Agreement by posting a new version; continued use after notice of a material update constitutes acceptance of the new version where permitted by law.
